1. Introduction
Heard Digital Ltd provides a subscription service that allows our members to access entertainment content over the Internet on various supported devices such as apps, and certain Internet-connected TVs, computers, and other devices (“Heard Digital ready devices”). These Terms govern your use of our service, which includes all features and functionalities, recommendations, and user interfaces, as well as all content and software associated with our service.
2. Subscription and Access
Membership
Your membership will continue until terminated. To use the service, you must have Internet access and provide us with a current, valid, accepted method of payment, which may include payment through your account with a third party.
Service Description
As part of the service, you are granted a limited, non-exclusive, non-transferable right to access the Heard Digital service and view our content. This right is for your personal and non-commercial use only and may not be shared with individuals beyond your household.
3. Billing, Changes, and Cancellation
Billing Cycle
The membership fee for our service will be charged to your Payment Method on the specific payment date indicated on the “Account” page. You authorize us to charge your next billing cycle’s fee to your Payment Method unless you cancel your membership before your billing date.
Cancellation
You can cancel your subscription at any time, and you will continue to have access to the service until the end of your billing period. Payments are non-refundable, and we do not provide refunds or credits for any partial subscription periods.
Changes to the Price and Subscription Plans:
We may change our subscription plans and the price of our service from time to time.
However, any price changes or changes to your subscription plans will apply no earlier than 30 days following notice to you.
4. Content and Usage
Geographic and Device Limitations:
You may access the service primarily within the country in which you have established your account and only in geographic locations where we offer our service and have licensed such content. The content that may be available to watch will vary by geographic location.
Usage Restrictions
You agree not to archive, download (unless permitted by the service), reproduce, distribute, modify, display, perform, publish, license, create derivative works from, offer for sale, or use (except as explicitly authorized in these Terms of Use) content and information contained on or obtained from or through the service.
5. Intellectual Property and Software
Intellectual Property
You acknowledge that any third-party claim regarding intellectual property infringement related to your use of the service is your responsibility, not that of the platform provider (e.g., Apple, Google).
Software Use
The software developed by or for Heard Digital Ltd is for personal and non-commercial use to access content through Heard Digital ready devices. This software may require updates that you will receive automatically.
6. Account Management
Account Security
The member who created the Heard Digital Ltd account and whose Payment Method is charged is responsible for any activity that occurs through the account. It is the members responsibility to maintain control over devices that are used to access the service and keep your account details and password confidential.
7. Miscellaneous
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United Kingdom.

Users must acknowledge that the Platform Provider (Apple, Google, etc.) is a third-party beneficiary of these terms and has the right to enforce them.
